There are several forum posts about this subject, some very heated :)  
Blue Marine and PushButton validate and they are core theme's.

Presentation of data is largly seperated form the theme.  Where there
are a few cases left and some contrib modules that muck it up, active
work is going to on to continue getting presentaiton out of Drupal
itself and relagating it to the theme only
