I'm not sure what's going on with core...

but what solved my problem is turning the menu block that I was using for the header into a "Menu Block" controlled by the Menu Block module from one that had been created by core.

All good now.

Maybe related to http://drupal.org/node/914382 or an issue for your
Headliner theme.
