Yeah, drupal_array_insert would do the job nicely, but it's not available yet. My fieldset technique works, it just adds a border around those two elements.

You may be interested in http://drupal.org/node/66183. It didn't make it 
into D6 or D7, but maybe something like it will make it into D8. Anyway, 
you can look through some of the patches to get ideas for how to write 
the code you want.
