I was recently awarded a settlement in a court case that had similar circumstances.

My lawyer is also a programmer and he understands these issues completely... 

and Jo's comment is correct -  A verbal contract is just as binding as a 
written one, only harder to demonstrate.

It took me 6 years to win, but the jury wanted to award penalties etc.
