How is the module limited from being used by anyone just because the 
name contains the word ban?  The GPL gives any user the right to

I don't see how the name of the module fits your complaint.  You are 
complaining that Open Source might be banned and that isn't the purpose 
of the module which is to limit who can access information but that can 
happen now with core Drupal and the access rules.
