Hi, Does anyone know if I can use Captcha with comments with out requiring a login, I want to keep them open but stop the spam.

Yes you can! The captcha module does that. Its handled by permissions, so just make the permissions screen open up comment posting for anonymous users, and enable captcha on the comment form.
